Okay have a quick question regarding separation agreements and how they are negotiated.
My ex is under this impression that, especially with the support, that he can barter how much he pays. To some degree, i do agree- I can't just ask for any amount and think I will get it. But at the same time, I do have more weight in deciding how much is appropriate. In this case, we have agreed to the table amount for the child support. That he has no issue with, obviously, cuz it's on paper and he can't find a loophole there (he's famous for that talent)
It's the spousal that is the issue. He feels that he can decide how much is appropriate, playing the 'I can't afford that much' card. I found out that I am entitled to spousal, as I was unemployed (maternity leave with the first child, and then stay at home mom after only 3 months of returning to work) at the time of the separation. It's been a bone of contention and a big part of the reason he continually won't sign the agreement so I can file it with the courts.
So, advice??? How is that process supposed to work?? can he say he can't afford the payments- he's in the military, make quite a bit and on paper, the payments can be afforded based on his income. He's using the fact that he has bills to pay, in particular old debts that NOW he's trying to rectify, and I just feel that I need some direction here.
