  • Unjust Enrichment

I just finished reading the unjust enrichment stuff on the website and was wonder how common is it a judge will order this in a common law relationship?

I have been home with my son for four years while he worked including a lot of overtime. He has put away about 10000 in rsp each of those 4 years. Would I be entitled to half of that. Also what about property that he has sold since the separation ( 3 cars so far that I know of)

    Thaks for your help

From what I understand in Ontario you must be legally married in order to be entitled to your common law spouses RRSP's. Again if I understand correctly you would have to prove why you are entitled to what I think they call constructive trust, re: RRSP's etc.
