    Hi, I would like to know,if one partner denies commonlaw relationship,what proof,by law is needed, to prove otherwise, or how is commonlaw relationship determined by law. ( 0ntario ),and if one partner moves to another province,which provinces`s law applies,or is there a difference.

    Hi kim,

    Except for a lease or deed showing both the parties' names, I think it's normally difficult to prove the commencement of a common law relationship. Unfortunately, it's really your facts against your partner's facts.

    As far as the laws that govern, I would say the laws of province in which the parties carried on their common law relationship would govern the separation. This is particularly so if the division of a home is involved.
