    My husband finds himself in a bit of a pickle today.

    He was scheduled for a sc on Monday but his ex requested it be adjourned. His lawyer has been trying since last month to get the date changed with the trial coordinator’s office. Yesterday we found out they still had not had a response from the TCO.

    If they didn’t confirm the appearance it doesn’t go on the docket for the day correct?

    (He will be having words with his lawyer about the performance of the assistant.)

    I believe it goes on if one party responds with a confirmation. Otherwise, respondents could just ignore all appearances and the applicant would never get relief. The judge can (and probably will) adjourn, but you can ask for costs thrown away since you showed up ready and the other side did not (especially if you can prove service so there are no procedural issues).

      Assistant reached out late yesterday to advise it was adjourned.
