I need some advice because I really don't know what to do anymore.
My ex and myself have been seperated for about 3 years.
I have been out of the family residence for about two.
I have three kids (ages 16, 15, and 11)
Settlement conference has been rescheduled 3 times. (The next one is January 31, 2007)
We had almost everything taken care of (settled) except for some of the money issues. I had a temp order from the court for Child and Spousal support etc.... The only thing left was to settle the money left from the sale of the house, and his RSP's etc....
And then the ex got fired from his job. (Some say he did it on purpose) So I stopped getting my child and spousal support payments. (Although FRO is adding the arrears up - As of July 1st - The amount FRO say's he owes me is over five thousand dollars.
I understand that when the ex starts getting his unemployment check that I will be getting 1/2 of that. (Which may not be for another 4 weeks or so, and will be nothing compared to what my regular payments should be from him.)
The ex (even though it is summer - has decided not to go and look for another job, instead he has decided to ride out his unemployment for as long as he can. This fustrates me because I know that there are jobs out there right now that he can do.
Ok, so this is my problem.... I needed answers. I needed to know what I can do to still settle this even if he doesn't have a job right now. I know that the money left from the sale of the house should go to me, because of child and sposal support that we haven't even filed / claimed thru the courts and FRO. (The ex did not pay Child and Spousal support for a year after I moved out of the house) I know that if I try to settle now, than my child and spousal support payments would be drastically reduced because he is not working. (But isn;t there some way that I can make him get a job?)
Anyways, I have been trying to get a hold of my lawyer for over two weeks to discuss all ofthis with her, but she still hasn't returned my phone calls. I e-mailed her assistant last week, (about 5 days ago) and I still haven't received a response from that e-mail.
I just don't know what to do - or how to proceed.
