    I've checked the definition of common law with CRA and my partner and I will not be deemed common law until we have lived together continuously for at least 12 months. She has a child (not mine) and she collects UCCB.

    Once we are deemed common law, both our incomes will be used to determine UCCB, and our combined incomes will far exceed the threshold for any UCCB.

    My question: Does UCCB just stop on the date that we're deemed common law or does CRA claw back the benefits to the day we started living together?

    I believe after 12 continuous months of living together you then have to fill out the RC65 marital status change form.
    If you no longer qualify it ends as of then.

      Thanks for the info. Once we meet the 12 month threshold, we plan to log on to CRA's web service and change our marital status.

      Hopefully, they'll just stop the UCCB payment and not try to claw back.
