  • Family vacation property excluded from settlement?

My parents gave (sold for $2) myself and my two sisters our family vacation property. I believe we are listed as tenants in common. One sister is in a marriage which can best be described as tenuous. In fact, they have separated once already. She was married at the time of the land transfer, but her husband's name is not on the title.

Is it possible to exclude this family property from any potential divorce settlement?

Also, I'm interested in developing the land (thereby increasing its value) further. Is there anyway to protect or exclude my investment from their matrimonal estate?

Perhaps this is best asked to a real estate lawyer, but can a TIC agreement detail who owns what and who has rights to what?

    Thanks
