    Husband is in a very bad way financially, however he is dealing with it in a destructive way. Do I still file child/spousal?

    Do you have the children full time? Yes you file for cs.

    You need to consider his work history, his ability to work in the past and currently and whether or not he is underemployed.

    Every parent is obligated to support their children.

      what are your grounds for SS? From your posts it seems like you were the one supporting him so you may end up not getting SS or actually paying him.

      You should go for CS. Are you looking for full CS or offset? Does he take the kids on a regular basis?
