  • Criminal Record

Just wondering if its normal for your criminal record to eventually erase, without a pardon?

Office of Children's lawyer cannot find a criminal record on ex, even though he brought a drug charge from BC to Ontario about 3 years ago. He also spent time in OCDC about 8-10 years ago. The police said its normal for it to eventually go off your criminal history within a 5 -10 year time frame.

Please advise if this is the case.

    Thanks

    mominont,

perhaps they were acquitted of said charge which would explain no entry of such.

I always believed entries on a criminal record remained and were permanent unless the individual received a pardon.

Every police agency has access to the central police information data base which stores information about information about individuals from all across Canada. Even if there was no charge, there should be a police report of the incident including officer notes on file.

Are you sure the OCL received the correct spelling of the name and their correct date of birth?

    another thing to consider is:

Do they have a relative with the same name?

    such as:

Joe Smith Jr or Joe Smith Sr
