  • Clarification correspondence—worth it or not?

    My partner is in litigation. Waiting for first CC. Her motion has no legal basis.

    He received correspondence from his kids in the vein of termination of relationship but includes false info as their excuse for doing so.

    My question is this: is it worth responding to false info? I ask because: his ex has used emails like this in her briefs and kids have terminated the relationship based on false info she gave them.

    I guess really its a question of how much weight these types of emails have on cc’s and motions.

    Not much as they have to be raised at trial or motion. Judge can't deal with evidence at a CC.
