    Changes to Child Support Guidelines Coming:
    Amendments to come into effect on 1 May 2006


    A number of changes to the Child Support Guidelines will come into effect in the spring of 2006, the first amendments to the Guidelines since they became law in 1997. Some of the changes are not particularly significant, although they do clean up a few issues:

    The definition of "extraordinary" for the purpose of children's extraordinary expenses will be clarified as those that exceed what the recipient of child support can reasonably cover, having regard to the recipient's income and the amount of child support paid.

    The income of foreign payors of child support will be determined as if the payor was a resident of Canada, to lower the payor's income if he or she lives in a jurisdiction with a higher tax rate. Currently, the Guidelines only allow the payor's income to be increased if the payor lives in a jurisdiction with a lower tax rate.

    The considerations the court must take into account in deciding whether a person should be exempted from the table amounts on the grounds of "undue hardship" will be changed so that the party claiming undue hardship must demonstrate not only that circumstances giving rise to undue hardship exist, but also that his or her household does not have a higher standard of living than that of the other person.

    The most significant change is the publication of fresh child support tables that reflect the changed taxation regimes in the different provinces since 1997. A special provision of the revised Guidelines expressly states that the new tables constitute a "change in circumstances" allowing anyone to apply to vary a child support order that predates the changes. The courts will have a rather busy spring and summer.
