  • Financial disclosure: $0 balance account

    Good day,
    Have a question about financial disclosure. I have a chequing
    account that was opened after the marriage, but on the separation date
    it's balance was (and continues to be) zero. Thus on all relevant
    dates (date of marriage, valuation date, and today) it's balance
    is "0".
    Do I need to disclose this account? It was a "petty cash" type account and was not emptied due to, or in anticipation of, separation.

    Better to be upfront about any and all accounts you have( even if the balance is and remains zero) rather than have to explain yourself after the fact. It will add to your credibility that you volunteer this information but if it comes to light months or years later it will tarnish your credibility and make the other side as well as the judge question what else you are hiding. Don’t give the other side any reason to doubt you or any reason to attack your credibility.

    The other thing you can do is close this account altogether. Litigation can take years. Why are you keeping it open if the balance is zero and remains zero? You can always open up another account after the litigation is finished.
