          Not really as he will still have to pay CS as the children would more than likely not be 50-50 or reside more than 60% of the time with him.

            Still not quite sure what this means. I guess I am loco

            Ok so there seems to be a consensus that moving in with someone new doesn't constitute a material change. I get this and would be the one provoking the change therefore not valid.

            However there are numerous other items that I think could.
            • Children being cared for by 3rd party when I could
            • A5 having issues at school; the teacher express concerns about the schedule
            • the teacher expressed concerns about nutrition
            • OP not willing to grant further access
            • OCL report is in OP favour based on lies
            • OCL report is dated


            The OCL report is dated, several things have changed. Is there a way I can get them to re-evaluate what's "truely" in the best interest of the children?

            Is there another process other than a Motion for Change?

              I just read another article about this "loco parentis"

              If I get it right, this refers to the "step-parent"

              Ie: responsibility to my GF children

                As I understand the concept of a "material change in circumstances", none of the above would count. Kids having issues at schools and being looked after by grandparents are not material changes that render the original order inappropriate or irrelevant, they are simply things that happen in life. Not every change is a material change sufficient to redo a final order.

                I also suggest that you take things one step at a time. You're selling your house, moving in with your girlfriend, and trying to reopen your settlement with your ex all at once? That's a lot of instability for the kids. I strongly suggest that you not be in too much of a hurry to try to blend the four (?) kids, as rapid changes in family arrangements rarely work out well.
