  • ISO: mediator recommendation in Ottawa

    Hi,
In search of mediator recommendations in the Ottawa area. We already have a divorce order - divorced for 7 years. However there are ongoing child parenting/custody issues. There is a mediator clause in the divorce order. For major issues we have to first go down the mediator route. I have to recommend 3 mediators and she has 10 days to select one - if not I can go to court to get one appointed.

Also appreciate any guidance how to work with mediators in the case where there ex is "combative".

    thanks!

Actually... The court cannot order a mediator only an ARBITRATOR. So the mediation clause is useless unless it includes ARBITRATION. You can bypass the mediation clause and go straight to court. The conditions to order mediation are near impossible to hit (as outlined below). But, if your clause said ARBITRATION the judge can order you to attend the arbitration.
