    My mother has been living with her common-law husband for almost 20 years and she has retire. Her husband is to retire in a few years but there is some health concerns. My mother is the beneficiary on all his work benefits but they don't have wills and I am concerned that if something happened to him that his family (his brother) would try to kick her out of their home, leaving her no where to go. Could you please advise how this works when there is no will?

      Agreed! A will eliminates the concern.

        get him to put her on the title to the house as joint tenants. That way when he dies his half automatically goes to her.
