    Hi there,

    Currently paying spousal support of $2,500 / month
    Child Support of $900 / month.

    Ex does not work at all at this point of time.
    Ex demanding / requesting day care amounts - around $350 to $400 per month in addition to Child Support.

    Questions:

    1. As Ex is not working so persumably she is at home all the time due to which the day care amount should not be demanded?

    2. If daycare is granted, does that imply that Ex is working somehow or somewhere due to which she does not have the time to take care of the child as Ex is not home.. due to which the spousal support amounts should reduce?

    Any comments?

    well if she is not working that in my eyes the child should not be in fulltime daycare. There may be times when she does need a sitter if she has a job interview etc.

      In any case - daycare should be less

      In any case this means that the daycare should be minimal in case she is not working.
      Ofcourse she would need to go for job interviews etc.. but the child should not be in day care full time if she is not working full time.

      Correct?

          Daycare should not be considered if she is not working. I guess we just need to clarify that she is not working due to illness, or disability? If she has chosen not to work to be with the children...then she is already compensated for that with the SS and CS.

            From the Federal Child Support guidelines:

            7. (1)
            a. child care expenses incurred as a result of the custodial parent’s employment, illness, disability or education or training for employment;


            If none of the above conditions is present, then the day care is her own responsibility.
