  • How Long Before Partner Can Take You to Court

    Rephrasing an original question:

How long does a commmon law partner have to take you to court for unjust enrichment concerning property? The mortgage is in my name only.

    Thanks,

I have heard anything from 2 years to 90 days.

I truly wish I could answer this for you. I have been searching high and low on this forum, and many many websites to find this answer. Hopefully, someone can point us in the right direction.

I found a pdf of the Limitation Act revised in 2004.

      http://www.glaholt.com/publications/...ished/027a.pdf

Essentially, it states that the general rule is 2 years from the time the wrong doing has been identified.

However, due to many loop holes (so to speak) it may be best to read over the entire document to see if it implies to your situation. But based on your previous post I believe 2 years applies.

      Hope this helps
