  • Filing a motion to change in a different city.

    Last year we went through the courts in brockville due to that being the city that both lawyers were in. I have sense moved to Ottawa and am looking to put in a motion to change. Do I have to file it in brockville or can I do it in Ottawa?

    If it involves custody you have to file in the city which is the child’s primary residence. Even if you have moved with the child. The primary residence is still considered the city where the original order was listed.

      You can always try to file in Ottawa and see what happens. I've often seen judges just accept the place where it was filed since the other potential location is not substantially better.
