  • Canadians For Family Law Reform (CFFLR)

A grass roots group has mobilized in Sarnia to bring public attention to the issues of Family Law in our country. The CFFLR was formed in the summer of 2011 be a core group of around 8-9 members. Both men and women are victims or family law not to mention our kids and their Grandparents etc. The group is advocating for big improvements to family law including simplification and more expedient decisions by our courts. One of our main roles has been to bring attention to the lawyer/client issue where lawyers are milking these families for all they can, threatening clients, over billing clients, conflict of interest issues between judges and lawyers, pushing proceedings into higher courts, creating hostilities when parties were ammicable, adjourning cases for months and years till the money is gone then firing the client.

The system is set up to bilk the life savings and equity of regular families seeking divorce. The lawyers, legal assistants, judges and court employees are directly involved in a false economy involving billions of dollars. Many of these people just do their job, observe the pain and suffering then go home. Many I feel would like to make changes in the current family legal system yet they dont for a variety of reasons. Keeping their personal source of income ranking highest.
Last night I attended a monthly public meeting and was excited by the energy in the room. Around 40 were in attendance. We will need to find a bigger room for next month most likely.
We had a public rally on Jan 26th outside the Sarnia courthouse. Around 50 came out during the day to hold signs and picket. The Sarnia Observer, Lambton Sheild and Sarnia This Week interviewed, took pictures and ran articles. The local radio was reporting as well. We created quite a stir especially for one notorious family lawyer who has drawn much of the ire. He is our poster boy for what is wrong with family law. Our group also picketted in front of his office. He is squirming like a wall street exec finally caught but so arrogant that he feels he is entitled. He called the cops several times asked for police escorts. It was the act of a coward. His safety was never in question with the picketers staying safely and lawfully on the sidewalks.
Our poster boy gets the highest case load in the city. Get this, he was observed to be on the docket for 37 of 39 cases one day in December as reported by a fellow member. He remmands almost all of them, deals with a few and bills for all. Nice day of work. Oh did I mention that his wife is a judge with the Ontario court? It would stand to reason that he wants his clients to elevate to Superior court. It also stands to reason that other lawyers are very courteous in court so as not to draw his ire for this might be mentioned over dinner. Yup a serious conflict of interest.
This chap is getting so ance he is issuing no trespassing and defamation summons on several members. Ironically some have never set foot on his property and the statements made are true hence defamation is of his own doing. A victim of his own success.
We are a group who demonstrate with dignity and respect. We are casting a light on some very dark issues in our family legal system. The system is so broke it must be blown up and rebuilt into a new model with the focus on the whole family surviving the process of divorce. The emotional toll is enough pain let alone the blood thirsty legal process leaving us all broke. Estates go to the lawyer while the bankruptcies go to the client. That is equality in family law.
We are hosting another rally on Thurs Feb 16th (9am - 3 pm) at 700 N Christina St, Sarnia in front of the court house. Bring a sign or just borrow one of our extra signs.
We are also hosting a candle light vigil on Monday Feb 20th (6 pm - 8 pm)at the corner of London Rd and Murphy to remember the tragic deaths of so many families due to our antagonistic family legal system.
Please find us on Facebook and our website. We have many people travelling from London, Kitchener and Chatham. We welcome all to our movement. The ripples of these travesties touch us all.

          Ace,

Congratulations on the success of your group. Thanks for posting on this site. Ottawa Divorce Forum is the largest in the country with over 20k members so keeps us informed of your efforts and success.

As blinkandimgone has alluded to try and use many more paragraphs on future posts.

Your large blocks of text, although important, is difficult to read in one viewing.

Break your points out in separate paragraphs and more people will read them

          Good luck

Thanks to all who have replied and thanks for your encouragement. I'll take your advice and partition this post a little better.

Seven course meals do get eaten, one at a time. Many would think it to be too much if it was all brought at once.

How do I edit my post

It would be gratifying and helpful to the cause, if like minded people afflicted in the same way by our courts, form a core group and begin the protests in other communities. This is not a localized problem. It is systemic throughout Canada. We are hearing of horrible injustices from across the country.
Help to curb this epidemic an save our families from emotional and financial ruin due to the gluttony and abuses of our Family Courts.

Yes, it is systemic across Canada. I am interested in Family Law Reform in BC. Are there any groups addressing this in British Columbia or anyone who is interested in starting one?

Gee I think i need a group for Family Reform of Construction because I paid too much for the expertise of my builder (in my opinion).

And maybe Family Reform of Auto Mechanics because they charge a lot too and I don't feel like paying.

Let blame lawyers and judges because they work in the system ...one bad lawyer makes the entire system wrong.

Expertise costs money. Information costs money. Ask any librarian.

                  In response to Beebie..................

                  Sarcasm is 'abuses" little brother.
Did not mean to hit a nerve.

This is not about one lawyer nor is it about one judge. It is about a system designed to squeeze as much equity out of a divorced family as possible. The existing parameters allow for this to occur. There appears to be no checks and balances for the lawyers and judges I speak of, those taking advantage as if it the job and their God given right to harvest money from these families.
There are many decent lawyers who still have a concience but most just migrate into other legal areas if they do not have the stomach for the blood letting in Family court.

Judges I think fall into 2 categories. Some are too overworked, cant get through the material given, then just pile on like a "line backer" based on a previous judges ruling. They are inundated with information, names, applicants, precidents, lawyers bickering, recess, lunch, adjournments, what court am I in, where am I?....... It is a whirlwind no one has the capacity for.
Some judges are categorically biased based on the lawyers in the room. Some are absolutely gender biased. With these judges it does not matter what is presented it matters who is representing you or what you represent.
Overworked, biased and jadded by the system. Yup it is a mess! Ask a retired judge.

Bottom line, it is the system that is at fault not the judges and lawyers. Having said that, there are those who take advantage of others based on the system.....just like an unsavoury auto mechanic or a dishonest contractor.

The current "system" does suck. It's more of a "set-up" than it is a system. There are many instances in which matters should not even get to Trial. I've dealt with several lawyers. Most of them do not have a conscience. I even took one lawyer to Court over his bill. It was $8,000. I was successful in not having to pay any of it. But that's not how it usually plays out. Even the Law Society (staffed by lawyers, most who have never worked out in the field) is a joke. As for Judge's - they are basically untouchable. No sense in lodging a complaint about them b/c it won't get you anywhere. Likely, just blacklisted.

I now have a better understanding of the police for loathing lawyers. Even though I was (am) the so-called "successful litigant" in my matter - I am disgusted by the Court System. It is a machine. Like a very high powered vacuum that sucks people up and spits them out.

The system is broken - Family Law is a hideous area to even talk about - you can't please anyone without pissing off everyone else.

As far as I'm concerned the crux of the problem are two (or more) adults who can't get it together to be reasonable. Emotions get in the way. Revenge wants in too.

There needs to be discussion about finding a better way forward. Right now the Family Justice System in Canada hurts families.

The existing system is way beyond repair or 'adjustment'. The family courts are working as designed and planned...to bilk Canadian families of their wealth.

We will look back at this mess ( I think sooner than later.....the ground is swelling with Canadian men and women ready to explode over this) with the same puzzlement on why we allowed smoking in hospitals.

We need to begin discussion surrounding an alternative model. This link by a senior, well respected family law lawyer makes the most sense to me

Hey "Stay single" that article is the real deal. Can you post it on the Canadian Families for Law Reform facebook page?
When things do not work well most people just complain. It is important to take the next step and that is dialogue towards discovery of a solution.
                          Status quo must go!
