  • Home Value for Calculating Equalization Payments

    Home value in 2006 was much higher than current 2009 value by 10 to 15%.

    I have not finalized my settlement.
    In Form 13B "Net Family Property Statement" it asks for today's home value.
    Is this figure based on 2009 value or the date of separation home value?

    Can the 2009 lower home value be used in calculating the equalization payments vs the 2006 higher home value?

    The figures used on your NFP are as of the date of separation.
    If this WAS 2006 then that is the assessment figure for the matrimonial home that you use.

      An article dated Wed Feb 4-09 from the Canadian Press named "Change in Economic circumstances factor in divorce deals, Ont. Court Rules" has me thinking that the laws maybe changing regarding post separation assets.
      Do a search online based on the aboce title. If you can't find it I will try to send you this article.
      I have saved it as a word document.
