  • Register Parenting Plan?

    Hi there,

    Through mediation we've come up with a parenting plan we both agree to. Now each of our lawyer's is going over it.

    Can you register a parenting plan with the courts? What would be the advantages/disadvantages of that?

    Or, should we include the parenting plan as an attachment to our separation agreement? Does that normally get legally filed?

    Any help appreciated.

    Sorry for the delayed response.

    Separation agreements, or any agreements for that matter, are not registered with the court. Usually, the first the court hears about an agreement is when a party brings an application to the court re a condition in a separation agreement that the parties can't resolve themselves.

    I think the best thing you could do is amend the separation agreement to include the parenting plan (perhaps as a schedule). However, this isn't necessary. A lot of parties deal with separate issues in separate agreements (parenting plans being the issue most likely to be dealt with separately I'd say). So long as each of the agreements are executed properly, you should be fine.
