  • Interjurisdictional Support Orders

Does anyone have any experience with this?

I have an Ontario court order issued July 2014 that awards custody and support. I need to revise the order to reflect the current child support payable and fix arrears.

The payor/respondent is in the US. It is enforced through FRO via payroll garnishments, pursuant to ISO Act.

The court order was issued in Ontario after the respondent moved to the US, but he was served in Ontario.

I went to the courthouse to file a Motion to Change, Child Support and the clerk advised that I could not file in Ontario as the matter didn't involve custody, only support. She handed me a wad of paperwork re: ISO.

The child lives in Ontario and all prior orders have been issued in Ontario.

Do I have to file for a change to my Ontario order via the ISO Unit? Or can I commence proceedings in Ontario?

    Thanks.
