  • ex wife returns after 15 years for pension

I met my husband after his divorce and together we completed the payments and moved on. Now he is in poor health and due for retirement.
His ex is threatening to take us back to court to grab 50% of his pension which will leave him unable to retire.
There is the second issue that the kids/grandkids will be dragged into this and stir up already difficult family relations.
We are told we owe her nothing but this is a tactic common to ex spouces as people make out of court settlements just to free the pension.
    What options do we have?

You can do a credit split with the CPP for up to a year after your divorce, so she won't be able to directly claim that.

She could claim up to half of what it was worth when they divorced. However, you would have to substract the amount that was taken into consideration when they divided the assets.

If they did a fair and equal separation of assets, it's highly doubtful that she could claim anything.

Bringing forth a claim like this after 15 years would seem to be pretty unreasonable. Isn't there a timeline afterwhich that claim would not be heard?
