Proportionate to income - before or after CS/SS is paid/recieved? Thanks

  • #2
If you are the payor... before CS/SS is paid.
If you are the recipient... after CS/SS is received.

Quite simply, you use the amount on line 150 of your Tax Return and Notice of Assessment.

That's what we thought, just wanted to be sure though. Everything's off the books, so to speak so we weren't sure where to start with numbers. Now we know, thanks!

I don't believe CS affects line 150. SS would though. CS has to be current before the payor can claim the SS amounts.

Not sure I understand what you mean by 'CS has to be current'? Thanks NB!

It's in the federal income tax worksheets somewhere...if there is an order for both Spousal AND child support...then the Child Support CANNOT be in arrears. If it is, then the payor is NOT allowed to claim the full Spousal support amounts. Government operates under the assumption that CS is paid before Spousal, always. So if you have a pending credit for 12,000 for spousal (1000/month), but owe 10000 in back CS....you get to claim 2000 for spousal, NOT 12000.

            Something like that anyway.

This might help: Line 156 and 128 - Support payments received and http://www.cra-arc.gc.ca/tx/ndvdls/t.../menu-eng.html

Thanks for all the help! We're just starting to look at making a written agreement and whether or not to bother with getting it done formally. All this info will help a tonne either way.
                Thanks again!
