  • Offer to settle prior to a trial?

    I brought a contempt motion forward against my daughters mother for continuously withholding access. Her lawyer and the Judge put the contempt motion over for trial.

    I am wanting to submit an offer to settle with her. Can I do that even though the judge ordered this matter to go to trial? If I do give her an offer to settle do I include this offer in my trial package that I serve on her and file with the courts?

    You can always make an offer to settle, and are encouraged to do so.

    Offers to settle are never shown to the court until the issue is decided and cost submissions are being made.

      we have the OCL involved do we serve a copy of the offer to them as well? I know that we are supposed to serve everything that we serve on my ex?
