    I was wondering if anyone could help me out with a detail.
    Is child support normally paid at the beginning of the month for that particular month i.e February 1st payment that covers the month of February? Or is it paid at the end of the month for expenses in the past month?
    We do not have an order for CS but my STBX is insisting that he only has to pay at the end of the week. He is currently paying weekly as he says that is the only way that he will pay it.
    Any advice?

    You are correct, paid on the first of the month for that month.

      I think "normally", you pay on the 1st of each month, for that month. That is how my husband pays his. My ex pays me every week, because he gets paid every week. Financially it made it easier for him to pay me that way. Anything can be worked out though.

        Should I be trying to get an order for the child support so that it gets paid at the beginning?
        My STBX is very difficult and things have to be done the way that he wants them done.
        I have been driving my children back and forth to school daily at a total of 68 kms a day. The doctors have written letters saying that this is in the children's best interest but he is refusing to pay any portion of the gas needed for this let alone the wear and tear on my vehicle. He is saying that it isn't for the children but for myself that I do this. I'm not exactly sure what I'm supposed to be getting out of all the running

          If you get an order, then most likely you will go through FRO. When you go through FRO, you have 30 days to pay without arrears. So be it on the 1st or the 30th. So maybe it makes sense to work thing out with him. Lets say if there is a way he wants to do it, then it will be only that one month that you will have to adjust to.
          Edit: Unless of coarse FRO garnishes his wages.

            Why are you so far from the school? Did you move?

            I'm sorry, maybe I misunderstood, but he pays you every week? Wouldn't that help, having the money each week?

            If he is difficult to deal with, you can get an order and then put it through FRO.

              I don't really think there is a set formula... my bf pays on the 1st and 15th of the month, but if he is paying you every Friday or what not, it doesn't really make a difference, as long as the total he is paying you in a month is what his monthly CS is... I would think getting the CS weekly would make things easier on him and you, since you have a weekly payment coming in helping with gas.

              Also confused about why you are driving so far? If you get an order and it does go through FRO, like was stated above, he would have 30 days after the 1st to pay his support without anything happening, but if it does go through FRO do know that it may take 2-3 months before you get a payment from FRO, as I have heard they are very slow.

              Best to just work for him... if the children are with you during the week then yes you are responsible for transporting them to the school, transportation is not a section 7 in which he would have to pay.

                It's not a section 7, it'd be covered by the CS he pays.

                Also wonder why you live so far out of zone? Did YOU move? If so, the transportation costs should be yours to bear alone.

                If you are the primary residence, then NEXT school year, you should be able to move them to the school you are zoned for, though he can argue it given you CHOSE to move. (if such is the case)

                In all reality, who cares HOW he pays it, as long as he pays it and isn't playing around with it as a control thing. If he starts skipping it or making unilateral changes to it, THEN you would have grounds to request it be done via FRO. (You'd need an actual order for this). Unless that's happening, leave well enough alone, most recipients would LOVE to have someone that at least pays regularly.

                  At the risk of making an incorrect assumption, it sounds like the children are in some sort of specialist school that has been recommended by "the doctors" as being in the best interest of the children? Perhaps the poster can clarify and provide more information on this.

                  The necessity and reasonableness of the need to attend this "particular" school will bear heavily on whether the additional travel might be considered a special section seven expense and even whether the travelling back and forth should be shared between the parties.

                  In respect to child support, if you elect to go through FRO the payor has a full 30 days to pay child support before it is considered "late." This is the case even if the court order specifies a date, eg the first of each month.

                    I drive more than 68 kms for my access, I wish I could get credit for the fact that it costs almost $10 in gas each time I need to pick up or drop off my son. But I don't. It's just a regular expense...

                    Though we need a bit more information about the school and why you live so far away, it does not sound like a special or extraordinary expense.

                      In a previous post, this poster states;

                      I will be moving out of the MH the end of July with my children. STBX has made it very clear that he only wants them EOW and I am more than happy to start that arrangement right after I move. I want to get the move done then so that the kids can be settled in their new home before they start school as they will be in new schools.
                      Which would suggest that she did in fact move out of the mat home, but knew the children would be in new schools... the question remains, why is the new house located so far from the current school?

                        Yes, I did have to move out of the kids school district. The reason being that I was living in a very small hamlet. I could not afford to buy out the matrimonial home. My daughter is in a wheelchair and there were no places in the school district that were wheel chair accessible. Her older siblings are also special needs and in grade 8. Due to the one having autism the least amount of change for him the better. One thing that I could do for him is keeping him in his familiar school till he can graduate this year. He is with familiar teachers and his friends.
                        As far as home life, the move was one of the best things for my kids. My son is no longer self-mutilating, which he was doing extensively before the move. The kids are much more relaxed.
                        The drive is not for my best interest...IT IS FOR MY CHILDREN!
                        Their medical professionals are completely supportive of the move as they can see how much better the kids are doing.



                        BTW...STBX and I were only a 15 minute drive apart but now he has moved to an hour away and wants me to pay for his gas to see his kids.
