  • Motion - Security for Costs

I spotted this recent motion on CanLii (Ontario).

I really like this motion and some may find this useful when dealing with ex who is trying to get relief from court for arrears.

    http://www.canlii.org/en/on/onsc/doc...17onsc285.html

"... Given the nonpayment of ongoing support and the fact that the respondent’s motion to vary in some respects appears to be a collateral attack of existing court determinations; this is an appropriate case to order security for costs...."

it's a little odd that they would hear that motion before a case conference. But I suppose it makes sense to get that figured out before the case starts. It now gives mom's lawyer the perfect opportunity to make the litigation last and cost $10,000. He's already got the $10,000 in a bag.

I wonder if the dad is able to make it last longer and cost more than $10,000.
