Great forum, wish I had known about it earlier.
Here is my situation.
Going through the divorce process.
Her choice not mine.
She thought it best to do 'Open Mediation'.
Through mediation, we get an agreement hammered out. Split the financial stuff, sorted CS (675 a month) and I was willing to go half way on spousal support for an indefinite time. Not sure that was good as it was a 15 year marriage but I figured it was cheaper than court. Both my wife and I signed the 'first draft' as did the lawyer who mediated it and a witness in a reputable law firm.
Herein lies the problem.
Apparently, in a mediated agreement, it has to be 'signed off' by the respective lawyers. Mine approved it with a few 'tweeks'. Her lawyer, who is very agressive said no way to everything. Hence, the ex thinks that she can do as she pleases. I.e. the agreement is null and void. (actually amazed you are allowed to do this).
She had moved out and I was providing her with cs and ss as I was advised, by the mediator. BUT moved back in, creating a fairly toxic enviornment.

So....here are a couple of questions.
I'm heading to court to get this sorted. Yikes.
I have an excellent lawyer but unfortunately he's not cheap.
Can I recoup any court costs?
She moved back in and decided to pay zero costs. i.e. not even soap to wash clothes. So, can any living expense costs be recouped....hydro etc.?
My lawyer seems to think the open mediated agreement will be the one the judge will go with but this will be a long drawn out affair.
Ironically, in the mediation, the mediator 'suggested' she switch lawyers as the ex's attorney is known for dragging things and promising her clients outrageous numbers.
