I am the payor and I hav a clause in our final order that states that if she cohabitates for 6 months spousal support ends. What is the actual definition of cohabitation? I have seen that the other person can actually still maintain separate residence and they can still be considered cohabitating if they act like a couple visiting eachother family, vacationing together, etc...
In my case this guy stays over almost every night, they take the kids to eachother families, they shop together for groceries and vacation together. I doubt he is contributing to rent as I pay for it all with support.
We are not on talking terms, but this is all information my kids have told me and things I have seen. Eg not there when I dropthe kids off because they are both at the grocery store, cancelled visits because they have gone on vacations etc... Should I hire a private investigator to collect information? What is it exactly that needs to be identified to determine cohabitation.
