  • Can you strike parts of a motion response

I got a response to a motion yesterday. My STBX admits to lying in an earlier filing. Now she asking the court to overlook the lies with yet another lie.

Do I have to file a motion to strike out the lies or do I just ask for her response to be dismissed. I saw duty counsel in the court but they spent so long trying to decipher the gibberish I never got a chance to ask.

You use it to your advantage. You respond to the item that is a lie with the facts, attach your affidavit or exhibit evidence to back it up, and move on.

It will just start to cement your stance that your ex is full of shit, and can't get their own story straight
