    Hypothetical question...

    Is it possible for the non custodial spouse to claim the ex spouse is underemployed and at the same time stop them from moving to another location for a better paying job if it is the only job they can find that pays more?

    Generally you can't seek something that is contradictory, judge's decisions have to be logical. By that I mean, in a judge's decision, if they find that a certain point has merit and it is the basis for part of the decision, they can't just discard that point for the next part of the decision. That said, if the NCP would pretty much lose access completely due the distance involved, then they would have a valid argument. Might not win, but it would be an argument.
