    Hi everyone,

    Back in court AGAIN! Ehhhhhh

    Long story short dad got fired from two well paying jobs, skipped paying months apon months of child support (while employed), was about to lose his license, so had to get a refraining order. As you all know, that just buys time. So he filed a motion to decrease his child support. I don't care about his money. I don't care about the 30k of back child support actually owed. I don't care that he's now dragging this out to cost me money. I care about being able to provide for the kids and still afford to keep our current home.

    He doesn't want to contribute to day care cost. Instead insist on using him, or his parents for day care. He lives a half hour away, his parents 20 minutes. He'll become employed "eventually" leaving me stranded for care. His parents have a laundry list of issues. Besides all this, winter months would require me getting the kids out of bed at around 5 am in order to get to work on time.

    So that's the scoop.

    Anyone know of any wording that basically says dad has no obligation to contribute or doesn't wish to so I can apply for subsidy? I didn't qualify before as they wanted dad responsible for costs. (Before order was issued)

    As long as you are the primary parent, they only use your income for the subsidy decision. At least that's the case in Toronto. Here, the issue is finding an available spot.

      Just because you tell dad he doesn't have to contribute, and let them know you've let him off the hook doesn't absolve him of any responsibility and put the taxpayers on the hook to subsidize you.

      You have an obligation to pursue support for your children from their father, not the taxpayer.

        If he has lost his job his income is less so maybe you qualify now.

          Do you have any written communication with him saying that he lost his job and has no income (so couldn't contribute to daycare costs even if he was willing)? That might work.

            Hey Blink! Long time no talk. �� I completely agree, but as I'm sure you know, FRO has a hard time "collecting" funds. So as it stands I've been months with a 0 amount received. I contact them every month to no avail. MPP tries, I get one month of payment and then wash rinse repeat. Hence the hole license suspension.

            I was told when I applied before, dad was responsible according to court order so I didn't qualify, will certainly be trying again though. I was a few years back.

            I have all his financials. He's out of unemployment as of November and has stated in affidavit he's basically going on welfare. (Can't get blood from a stone) I just want to settle the nonsense so I can stop wasting money on a lawyer and get back to focusing on the kids. I was hoping that getting the section 7 (day care only) off the table we could both move on with our lives.

              I would word it that you are looking at putting them in daycare or something abit more formal like Montessori. Kids need structure and routine and this is pretty reasonable request.

              If he is going on welfare soon, you should be able to get the subsidy. Heck even if he was working you should still get it. My judge put in the court order that she uses her subsidy and I was to pay the non subsidized portion as I myself don't qualify due to my income.

              In terms of the whole taxpayers footing the bill, why not this is Canada we are a semi socialist society. I earn in the higher tax bracket and I have no problem paying higher taxes to support the needy. If you don't like it, you are in the wrong country and need to move somewhere like United States.
