  • Rental property division question

    Greetings.


    I have owned a rental property by myself since 1998. Mortgage payment came from my chq account.
    Married Oct 2012.
    Added spouse jointly to Chq account in Feb 2013


    Rent chq's deposited and mortgage payments continued from the now joint account until Nov 2017 , then were moved to a separate single account.


    How would this asset be calculated to split ?

    The amount of property increase since the date of marriage would be considered an asset. The income you receive annually from the property is considered income for your ss and cs obligations.

      I believe it works out to 50% of increase of value of property from time of marriage to separation for equalization of assets. You mixed income from rental into your joint account.

      Child support is based on income. Spousal support is entirely a separate matter and there are no set scales/guidelines.
