  • Subpoena to appear (not Family Law)

Unrelated to family law.... thought this might be a good place to ask about the power and limitations of Subpoenas...

My son is away (in Ontario) at University and has been issued a subpoena to attend a trial in Ottawa as a witness to a car accident. No injuries or anything... the driver responsible is trying to get out of it on a technicality.

It is crushing for him to have to pack up, travel, and miss this very important part of his early school year.

If he does not show, can he really be arrested for contempt? or does this yahoo's "legal rights" take precedent over everything and everybody?

Maybe he can ask to do a pre trial deposition recorded by a stenographer by way of vidéo-conférence. Or appear at trial by video conference.

The party has to pay his travel expenses too i think
