  • Proceedure on Minutes of Settlement

    I am almost through this nightmare, however there is one more hoop to jump through: Minutes of Settlement.

    Apparently before any funds are to be deposited to my account I need to sign Minutes of Settlement. I am under the impression that both of us need to draft this settlement.

    My questions to you all are:
    1. Do I need to draft my own Minutes of Settlement?
    2. Do I need to then file this with the court?
    3. If after filed with the court is this document served to the opposing party?
    4. Which form do I use?

    1.Either one of you or your lawyers draft the Minutes of Settlement, which you both sign.

    2.Yes, the Minutes will form the basis of an Order on Consent.

    3.Each party retains a copy on signing and the subsequent Order will be given to both parties.

    4.Minutes of Settlement are often drawn up on blank lined paper and later turned into an Order with a judge's endorsement. I don't lknow whether there is a prescribed form. If there is, I haven't seen it.
