  • 11 year old dead, father charged with first degree murder

    https://www.ctvnews.ca/canada/first-...lice-1.4298391

Aside from the idiots who complained about the amber alert system waking them up last night- this is the story everyone is talking about today.

I try not to get too chicken-little-the-sky-is-falling about these things...and I try to remember my situation is different because supervision is there for my daughter.

This whole story has me so angry and heartbroken for this little girl, and her mom.

This is a horrible story. I haven’t read the news update but I’m sure we are going to hear more. I can’t imagine the mindset to do this and possibly it involved mental illness or anguish. My heart breaks for the little girl.

My heart sank when I read that this morning. As a father who tries so hard to be the best parent I can possibly be, this really cut to the bone. I'm not a capital punishment person, I think the justice system is too flawed to trust, but sometimes...

That said, while this is an incredible (and almost unthinkable to me) amount of pain for one mother, this guy just caused a lot of pain for hundreds if not thousands of other fathers. Judges are going to be much more reluctant now to allow unsupervised access when mothers make spurious claims of potential threatening behaviour.

Divorce is Canada is going to get nastier.

News update is he was charged with 1st degree so premeditated and he is currently hospitalized.

I don't like the sound of hospitalized, that seems like the beginning of an insanity defense. Urg.

I thought I read in the initial report somewhere he threatened murder suicide, so maybe he physically hurt himself as well but not bad enough.

Or the cops hurt him during a take down. He was captured near Orillia.

He definitely did. And I hate to play the race card- but I truly do believe there is a stereotype of south-asian males that this just played right into. Although- in this case- the father is actually west indian. I think there's sort of an undercurrent that I've seen emerging reading a ton of case law...I think the courts side-eye south asian males- whether they admit to it or not.

hopefully it's just because he has physical injuries... he was transferred to a trauma centre.

I actually slept though the amber alert and woke up to this tragic news and thought of Iona.

As more details eventually come out it will be interesting to see if they were involved in the Family Court system and if the Mother raised any concerns there.

The news I’ve seen and heard seems to be focused on the idiots complaining about being woken up by the alerts on their phone and not about the death of this child by one of her parents.

He kidnapped her. That makes 1st degree automatic, so not necessarily premeditated... not that it makes it any better.

The tragic thing is that domestic homicide is the most preventable homicide there is. There is an interesting article about the death review committee ( a committee which was formed to review all the cases of domestic homicide across Canada) and their recommendations. Maybe one of the tech savvy members can pull up the article.

The committee found that there were certain common risk factors ( about 30 in all). Each case had four or more risk factors. Some risk factors were rated more dangerous than others. Some of the risk factors included:

                        - going through a separation or divorce
                        - alcohol or substance abuse
                        - history of death threats to spouse, children, pets
                        - mental illness ( including brain damage)
                        - unemployment or financial stress
                        - stepchild in the family ( sexual jealousy)
                        - history of controlling behaviour
                        - history of false accusations of an affair
                        - dependence on the spouse
                        - isolating the spouse
                        - history of assault
                        - history of strangulation
                        - history of threatening with a weapon such as a gun or a knife
                        - history of hostage taking or forcible confinement
                        - involvement in family court

These are the ones I can remember. The report slammed custody and access assessors for not completing any type of risk assessment and judges for ignoring evidence. They also found custody assessors had little to no domestic violence
                        training.
They recommended all custody assessors have extensive domestic violence training and perform lethality risk assessments on all high conflict divorces. They felt that using the lethality risk assessment was an effective way to differentiate between real risk and false allegations. All of their recommendations were ignored.

In my own case I had hard core evidence from CAS, police, his doctors , his psychologist and his specialists. Even if you took away everything I ever said and only looked at what third parties had to say, any rational person would have declared “Houston we have a problem”. The judges did all order supervised access but they minimized all the evidence and put the children at terrible risk.
The custody assessor was the biggest idiot to ever walk the planet. She recommended I have sole custody and that he have unsupervised access. They did this without conducting a lethality risk assessment. CAS had stepped back at this point because the court was involved. They agreed he was dangerous but said they couldn’t do anything until he physically hurt the children again.
Something did transpire again which I will not get into here. Suffice it to say because of this incident the judge did not follow the recommendations of the assessor.

In the case about this poor 11 year old I bet more of the risk factors are present than just separation. I also feel that if judges and court assessors had the proper training they could easily identify those at high risk and put safeguards into effect without negatively affecting innocent fathers and mothers who simply don’t get along.

It's really too bad that the two independent issues are intertwined; the tragic death of a child and a terribly implemented amber alert system. Hopefully, the implementers of the amber alert system will get their act in gear and fix the system.

                            https://toronto.citynews.ca/2019/02/...sissauga-girl/

At least he spared the tax payor the expense of a trial and incarceration. My heart breaks for her family. But I’m not sorry he died. I guess he thought they could live together in enternity.

I do agree with the mayor of Mississauga that this needs to be a wake up call for violence against women. We may never know now if the Family Courts were involved, but obviously the Mom had some kind of court order.

The only problem is that he died of a self-inflicted wound, which means he intended to die.
