Safe to engage in DIY mediation using 'Without Prejudice' emails?
05-20-2018, 01:51 PM
I am wanting to make a settlement offer to my ex, without prejudice.
Would it suffice to simply header the email "WITHOUT PREJUDICE"?
Thanks!

Settlements are always "without prejudice" and cannot be disclosed in court proceedings. Well established rule. Anything marked "offer to settle" will be stripped out of the record and the person attaching it will be slapped.
