  • Dividing the House

    A couple purchases a house together. They have not lived together before, are not married, and therefore are not in a common law relationship when they buy the house. There is no written agreement. They put in unequal amounts into the purchase of the house. They live in this a house for a period of time (3+ years) and have a child. They separate.

    Do the courts divide the equity in the house equally or based on the percentage each partner put into the house when they purchased it?
