  • CanLii Filter between Motions and Trials

    Hi all,

I'm trying to filter between motions and/or endorsements and trial for family law cases.

Is there a search query or filter that can help with this? At the moment I'm going through them one by one.

You can search for "final order" vs "temp" or "interim"; although not sure why jurisprudence would change for motion vs trial.

Depends... most times at trial they want trail jurisprudence because the evidence has been weighed properly. On motion you will often read in the decision that the matter needs to go to trail etc... So a trial judge wont' rely on jurisprudence that hasn't had the full weight of considerations of a trial/testing.

There are often different tests. For example, the status quo is more important at an interim parenting motion than at trial.
