  • Trial coming up, have not been served...

    I have a trial coming up shortly, I am well inside the last month.

    I have been served the TR (Application, Response etc.) but I have not been served a factum, BoE, BoA etc.

    Should I proceed with my own factum on the basis of what is in the Application and serve that? Or should I create my factum based on what I anticipate the arguments are going to be from the other side?

    I suspect that the most likely case is that their factum will be served at the last second in order to give me no time to reply and serve myself.

    Hey OD, I recently finished 3 days at trial. I was served at trial record and added to it. I had the option of serving a book of exhibits as well. All timelines for service were given the trial management conference in the endorsement. No factum was necessary. A list of witnesses was given as well.

      You need a lawyer

              That service is a crock of shit, they offer to relieve you monthly of that pesky money we're all burdened by in return for their fine print that says should you find yourself with a false DV, stalking, drug or alcohol related charge or in need of bond/bail assistance - you're fucked. How often does that happen in family law cases?

                    I think the members can see them for what they are, a quick google search of their 'company' name and 'scam' proves to be most useful.

                    I love the smell of trolls in the morning......

Legal insurance is for idiots who can't or are too lazy to do for themselves, so pay to mitigate the risk.
