  • Costs for a motion to the other party

So i am being served with a motion. If i make an offer to settle and the offer is rejected and if the judge doesn't rule to all requests on the applicant favor, do i still pay the legal fees for the applicant?
    Thanks

Generally a judge rules costs in favor of the person who is successful in the majority of the items. If it is a split decision then both parties pay their own respective costs.

Remember that "costs" are not 100% of a persons's legal fees but generally in line with a schedule of costs as prescribed by the court (in Alberta at least - these are referred to as 'Schedule C' costs).
