  • closing a legal loop hole in Alberta

    Alberta Children's Services (Alberta's version of CAS) told me my file would
    be used by a committee for the purpose of amending Alberta's higher court Queen's Bench (QB) allowing it to grant Emergency Protection Orders (EPO).

    This was completed awhile back - QB does grant EPO's now.

    Why does this matter ?

    Provincial Court EPO's are useless here if the accussed
    gets a order for house/cars/money/kids from Queens Bench.

    With a provinical EPO my children ended up in foster homes, me homeless because we tried to escape from domestic violence while wife tried to
    score house,cars and money. Her advisarial lawyers walked through the
    provincial EPO with such precsion and timeing I doubt I was the first this happened to.

    but I am probably one of the biggest noise makers it happened to ...

    Giving it some thought I take some comfort in being linked to positive
    change , hopefully the corrupt element here in Alberta doesnt figure out another way to deny father's and their children protection.

    I am not aware of women with an EPO being subjected to what I was but they too benefit here which is how the system is suppose to work.

    close to 50/50 then hug a custodial father today".

    Is this information posted publicly by the government of Alberta or is there a case file (reference) of any sort so the resulting case law / etc can be shared with the rest of the forum?

    It would be very useful to others to see how you "made noise" to bring attention to the problem and get the wheels of change started.

      Emergency Protection Order (EPO)

      An EPO can:
      • order an abuser not to go places where the victim regularly goes;
      • order an abuser not to communicate with the victim;
      • allow the victim to stay in the home and order the abuser to leave; and
      • allow for other conditions necessary to protect the victim.
      There is no cost to get an Emergency Protection Order. Victims, Children and Youth Services caseworkers and police can all apply for EPOs 24 hours a day, seven days a week. Adult victims can apply for an EPO at provincial court. An EPO must be reviewed in court no later than nine working days after it is granted.

      Court of Queen’s Bench Protection Order

      A Court of Queen’s Bench Protection Order covers the same things as an Emergency Protection Order and more. It can:
      • order an abuser to reimburse the victim for loss of money resulting from family violence;
      • determine who can temporarily possess personal property;
      • order counselling for an abuser; and
      • authorize counselling for a child without the consent of the abuser.
      brings back alot of memories - the key here is under Queens Bench the EPO will trump ex-parte and similar order ...

      the QB EPO item 'authorize counselling for a child without the consent of the abuser.' is important here in Calgary - I tried to sign my children up for "abuse" counselling using Children's Services & existing Court documents and was turned away because their abuser wouldnt sign ...

        in just 3 days 500 men in calgary read what they did to my children here in calgary , the mother grabbed the house and cars and money - I was homeless but MUCH MUCH WORSE my 3 little girls were divided into separate foster homes ...

        why ?

        cause I filed for a provincial EMERGENCY PROTECTION ORDER , and her lawyers walked right through it ... police cars up on the curb, father is escorted away ... and my children are left with the person who put their foot on their neck till they blacked out ...


        FATHERS IN ALBERTA - DO NOT FILE FOR PROTECTION IN ALBERTA PROVINCIAL COURT IF YOUR X BEATS THE SH1T OUT OF YOUR CHILDREN AND YOU - GO NOW TO QUEENS BENCH - IF THEY WONT GIVE YOU AND EPO THEN RUN FROM THIS COUNTRY or end up like this father with 12% access to those you tried to save!!

        just saying - cause thats what happened to my children , and I will not be quiet about what they did to my children till things change here is ALBERTA ...
