  • CCTB Question

When you split the CCTB - is each parent's entitlement based on their respective incomes?

So ... if Mom is eligible to receive for 6 months based on her income of 60,000, what if Dad's income is 200,000? His household income is too high to get the CCTB - does no one get it for the other 6 months then?

    Yes, that's right.

That's not really "advertised" by the CRA - do they say somewhere "you are entitled to half the CCTB, haha, gotcha, no you're not".

Well they do say you're entitled to APPLY for it and typically reference amounts you MAY be entitled to recieve. They have a handy little tool here for calculating how much you'd likely get before applying:

So ... got a little distracted there ....

just curious now ... if Mom has been receiving CCTB and now custody moves to 50/50 and Dad decides to apply for CCTB, even though he knows he will get nothing, does Mom lose 6 months of CCTB?

Yes, she doesn't get it for the other six months. But I wouldn't say she lost it, since she never had it.

Very true - She will not continue to receive it

Total grey area, not "currently" enforced. Might be a bargaining chip if needed. (mind you any agreements respective to the CCTB aren't binding, the court has NO jurisdiction over them).

Applying for it can be construed as a "prick move" and can add to an already volatile situation. Once it's done, it's NOT easily undone except by a change of custody. Especially if the other party has not kept their address updated with CRA.

so in a shared 50 / 50 arrangement of one spouse claims all the kids for tax purposes but ccra is aware of the shared arrangement does it affect the CCTC?

If the CRA becomes aware of a shared parenting situation they will prospectively change the CTB to shared between the two parties.

Have you ever seen them do this?
