There are a lot of “programs” that are only two years which does not lead to a diploma or degree. Regardless of your agreement, a judge will still order support paid until the child has an education that completes a degree. From the sounds of it you don’t even know what the child’s education or program is so it was very bold of you to try to stop support.

Added to that, just because you sent forms to FRO does not mean it stops. The form is sent to the recipient to confirm the child is not in school. Just because the ex ignored the form doesn’t mean you simply stop. You still pay until they say stop.

I caution you now that you may also be on the hook for school expenses too. Prepare yourself for that.

Totally aware of the program and what school

        The course details and all.

They said the support didnt need to be paid
Those where the words from them.
I have been however putting the funds aside so I'm good.

We shall see where it falls.

Not a parent who doesbt pay.

There are some conditions where CS will not be paid:

            1.
Child ceases to reside with parent
Child is residing with parent, so this condition is not met.

            2.
The child be becomes 18 yrs or age and ceases full time attendance at an education institute
Child must be both over 18 and not in full time attendance. Child is over 18, but is in full time attendance, so this condition is not met.

Since neither condition for ending CS has been met, you must continue to pay child support.

              Child is over 18yrs
and not in school full time

Hasn't been in school full time

I agree and know that both must be met

School was done in April and now child has started again in September. That is full time. They may have started a new 2 year program. You will have to pay.

Regarding the FRO letter... if the other parent agrees or does not respond, FRO will tell you the payments stop. My husband actually received a refund.

Seems FRO is lenient about the “30 days to respond” rule.

                  This is the issue .
                  Nothing discussed nor advised.
                  I need proof of attending.

Hopefully she responds with my layers request.

Absolutely if in school full time I pay.
But if not ...than support ends.

She lied and said she never got the letter and where would the support have been? Pretty sure someone who never missed a payment would have been asked by recipient.

                  Its like pulling teeth.
She didnt want to disclose the original I information when child started post secondary the first time.

Child should definitely finished his schooling but keep me in the loop and should it be another degree just tell me.
Again I have no issuing paying.

No arrears with FRO as enforcement stopped.
                  I paid FRO directly.

I have this with the lawyers now.

FRO sent papers closed case and no arrears
                    That's why payments stopped

Need proof of actual attendance and grades
Going to get court order for transcripts
