  • Judge: Not allowed to post about legal disputes on social media

    From http://canlii.ca/t/hq1lk

    [66] The Court makes the following final order in regards to the use of social media by the Respondent: <svg xmlns="http://www.w3.org/2000/svg" class="lb-i" viewBox="0 0 1920 1408" width="0px" height="0px" />
    <svg xmlns="http://www.w3.org/2000/svg" class="lb-i" viewBox="0 0 1792 1408" width="0px" height="0px" />

    1. The Respondent may post photographs of the children on social media such as Facebook. However, he shall not post any comments regarding legal disputes, access issues to the children and/or derogatory comments made against the Applicant.

    That's a little scary. I don't often say this, but when it comes to free speech, I think Canada needs to follow the American model more. No American judge would issue such an order.

    Now, the Dad should probably have kept his kid photos and political rants separate. However, that's poor decision making, not something that should be illegal.

    Best paper I have read on the subject matter of parents rights to free speech vs a child's right to privacy.

    Remember, what you write on public social media can emotionally harm a child. So, these orders are trying to restrict the potential for the child to be harmed by the parent's possibly abusive conduct on the internet.
