Spousal support - does income matter for the duration or just at separation?

  • Spousal support - does income matter for the duration or just at separation?

    For example, with a 5 year cohabitation period - do the spouses' incomes at year 1-4 play a factor?

    Perhaps the mean, median, or mode of all 5 years are used?

    I'm trying to figure out which income value to use to assess appropriately.

    Generally it is the current years salary unless there was a drastic change in income. If there was a drastic change, reasoning would be needed to argue why other years should be used in the equation.

      I've heard mention of looking at the last 3 years, especially in cases of varying income, such as when one spouse is paid on commission, bonuses, or is self employed.
