FRO closed and now open again

  • FRO closed and now open again

    closed in april due to schooling ending , no proof of this attending or continued schooling - no grades - it was a 2yr course
    21yr old kid
    registration shows 17-19 - not for 2020

    Now FRO says its open again and we need to pay since april , she lied and said no letter ever received by them and therefore she didn't responded ..what a huge lie
    would she not wonder why she wasn't paid
    pretty sure we need to go to court , this doesn't make sense and she is grasping for money , the child isnt in school
    unfortunately she needs to release with FRO until than he has no choice but pay again and arrears which in no fault of this own


    court is best , even if self represented

    why the system works against paying people as well , makes no sense , any thoughts on court ? and getting this on own

    He needs to file a motion to change to terminate support. FRO will reach out to the other parent but they can lie.

    Does the agreement say child support ends at age 21? If it does then he needs to have FRO look at the agreement. Normally when you make them read it on the phone they give an answer.

    If he is under 21 and back in school then yes he does have to pay again.

      clearly believe he isnt in school , requested grades and no answer , why would she wait 6months and lie and say she never got the papers , yet we did , and not wonder why payment wasn't being made , all to fishy
      need to go to court get the real answer
      clearly someone isnt be honest and making it work for her , and now arrears for 5months ,
      not fair
      I dont think a judge would like this behavior

      now she threatens garnish , when he always paid on time and every month

      It ends at 21 but in school full time , child turns 21 early next year

        You just said the same thing as your first post. You need to file a motion to change to end support. Do that ASAP... FRO can only enforce orders and so if your order states you pay until 21, then you pay until 21... it’s not hard for them to fake letters from schools

          You’re not making sense.

          You have an order for support until they are 21. Kid is not 21 yet. Kid was in school until April and then went back last month. You DO owe support for April to now because kid went back to school.

            yes its a repeat and a lawyer will be the next step and than court , done with this situation sadly , no issues paying ever have and clearly after never missing a payment why would someone start now after over 20yrs ,
            FRO should be able to require that and enforce that as well .
            all good , thats why they have lawyers and court

              No support ended as child was done 2year course
              In April
              Did the termination of support with FRO and she never replied till now 6months later saying she never got the letter
              Its reopened now
              No issue paying as in school
              Order up to 21yrs in school full time
              He isn't in school

              Need to go to court to settle this with either true proof or
              Get the court order to stop

              Took you advise on the form from FRO but now this
              The case was closed since April when documents were asked for
              She claims they were never recieved

                  FRO can reopen if she chooses to and not close it with consent from her
                  Clearly going to court
                  Need this taken care of so FRO can truly now close it for good

                    Ok without typing any extra word vomit, WHAT EXACTLY DOES YOUR ORDER SAY?

                    -Child Support payable until child is 21?
                    -Child Support payable until child is no longer a full time student?
                    -Child Support payable until child is 21 AND in some form of school?

                    Just type exactly what your order says

                      My guess is your order says something about paying child support until child is 21 as long as they are a full time student.

                      I am also guessing your kid enrolled in some sort of 2 year program after high school, and completed that program in April.
                      You then filed to end CS as you figured child was done. Or maybe you had a suspicion they weren’t but decided to jump the gun anyways.
                      Child then decided to continue their education and enrolled in new program/degree/whatever and began school in September. Mom contacted you and said HEY! Kid is still in school, you still have to pay.

                      Summary: you still have to pay.

                          That’s what it reads word for word? If so, that’s very poorly worded... when was your agreement written that it states the child is 18 years of age? and if the child was 18 and not in school when you signed the agreement then how do you have arrears?

                          It’s really hard for anyone to give you actual helpful advice when the details provided make no sense...

                            Both conditions must be true for child support to end.

                            If child is in school full time, then child support does not end.

                              Child did finish 2yr program
                              Mother didnt notify and no word on anything
                              Please understand we arent here to say not to pay
                              If in school ...yes of course
                              Never missed a payment why now?
                              However I have no proof of full time attendance
                              No grades .No new registration
                              Completely out of the information on this
                              And when asked. No reply.
                              If support continues no issue in doing so.
                              Sadly I meet all requirements always and when asked no responses.

                              This has been handed over to a lawyer and clearly a,court issue..unfortunately
