    When my mother passed away and I inherited some money I used that money to pay back 9 years of my pension that I had previously withdrew to help buy the house. I worked for 31 years. Does this mean that my spouse is not entitled to 9/31 of my pension?

    Inheritances are excluded from division of family property, but if they are co-mingled into other assets and/or used to pay down other debts, they lose their distinctive character and will be included in family property to be divided.

    I fear that you won't be able to exclude the inheritance since you co-mingled it into your pension fund.

      I agree with dad. It's wrong but another stupid part of our laws.
