House is sold. All disbursements have been met except her equalization payment which is a RRSP spousal rollover, we need a seperation agreement in place/signed to avoid tax implications.
We were almost at the end of a seperation agreement, he wanted to change one thing and she went ballastic and now is threatening to change her tune and go after spousal, retro child support and additional childcare expenses. In the agreement was no spousal, current child support and 50/50. She thinks he is holding it on purpose to screw her over and make her committ to a sep agreement because she has a huge debt to pay for a house she shouldn't have bought. Anyhow he sent in the form without the agreement in place.
He has been paying child support for 2 months and 50% daycare etc.
He couldn't pay child support before until the house was sold, he was covering a mortgage of an empty house and daycare costs, she moved out when she didn't have too.
Can we tell her until an agreement is in place he will just pay child support ? What are the obligations BY LAW ?
What can we do here ?
