  • Contempt of Court Motion

Has anyone successfully filed a contempt of court motion under FLR 31?

I have had custody of my daughter and son since 2005 and 2009 respectively. Since summer 2009 my Ex has refused to pay child support according to a written agreement made by us, so in February 2010 I commenced the process in Ottawa to obtain a support order. The bottom line is, since the trial is not until end November 2011, on motion, the court ordered temporary child support to me. My Ex has still outright refused to pay and is two month in arrears for the temporary order, notwithstanding that she is a high income earner and has little debts. The FRO said that, since the order will be under the ISO rules (Ontario - New Brunswick), I likely will not see anything until late in 2011 as there are two enforcement processes to go through.

In your opinions from your experiences, would filing a contempt of court motion be appropriate?
